Welcome to Tera Mera Bazar (“Platform“, “we“, “our“, or “us“), a B2B marketplace for pharmaceutical manufacturers and buyers operated at teramerabazar.com. By accessing or using our Platform you agree to be bound by these Terms and Conditions. Please read them carefully before proceeding.
1. Acceptance of Terms
By registering an account, accessing the Platform, or using any of our services, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, you must not use the Platform.
2. Eligibility
You must be at least 18 years of age and legally authorised to represent the business entity you register with. By creating an account you represent and warrant that you hold or are authorised by the holder of valid drug manufacturing or trading licences required under applicable Indian law (Drugs and Cosmetics Act, 1940, and rules thereunder).
3. Manufacturer Accounts
Manufacturers must provide accurate company information including GST number, drug licence number, and registered address. You are responsible for keeping your account credentials secure. Any activity that occurs under your account is your responsibility. Tera Mera Bazar reserves the right to suspend or terminate accounts found to contain false or misleading information.
4. Product Listings
You are solely responsible for the accuracy, completeness, and legality of product listings you publish on the Platform. You must not list:
- Controlled substances without valid authorisation
- Products that do not comply with applicable quality standards (GMP, IP, USP, BP, etc.)
- Counterfeit or misbranded medicines
- Products for which you do not hold a valid manufacturing or trade licence
Tera Mera Bazar reserves the right to remove any listing at any time without notice if it violates these Terms or applicable law.
5. Lead Generation Service
Tera Mera Bazar facilitates introductions between manufacturers and buyers (“Leads”). We do not guarantee the quality, seriousness, or conversion of any lead. Leads are distributed according to your active subscription plan. The Platform acts solely as an introduction service; all commercial negotiations, transactions, and contracts are exclusively between the manufacturer and the buyer.
6. Subscription Plans & Payments
Access to lead generation and premium features requires a paid subscription plan. Plan details, pricing, and lead quotas are described on the Upgrade Plan page within your dashboard. Subscription fees are charged in advance and are subject to our Refund Policy. We use PCI-DSS compliant payment gateways (Razorpay / Cashfree). All prices are in Indian Rupees (INR) and inclusive of applicable taxes unless stated otherwise.
7. Prohibited Conduct
You agree not to:
- Provide false, inaccurate, or misleading information in your profile or listings
- Use the Platform for any purpose that violates applicable law or regulation
- Attempt to circumvent the Platform by transacting directly with leads obtained through the Platform (outside the agreed lead fee or plan structure)
- Scrape, copy, or reproduce any portion of the Platform without permission
- Upload malicious code, spam, or disruptive content
- Harass, defame, or harm other users of the Platform
8. Intellectual Property
All content on the Platform — including logos, design, text, software, and databases — is owned by Tera Mera Bazar or its licensors and is protected by Indian and international intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent. You retain ownership of content you upload but grant us a non-exclusive, royalty-free licence to display it on the Platform.
9. Disclaimer of Warranties
The Platform is provided “as is” and “as available”. We make no warranty that the Platform will be uninterrupted, error-free, or free of viruses. Tera Mera Bazar is not responsible for the accuracy of manufacturer listings or the outcome of buyer-manufacturer transactions.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Tera Mera Bazar and its directors, employees, and partners shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of your use of the Platform. Our total liability for any claim arising under these Terms shall not exceed the amount you paid us in the three months preceding the claim.
11. Termination
We reserve the right to suspend or terminate your account at our discretion if you breach these Terms, provide false information, or engage in conduct that we determine is harmful to other users or the Platform. You may also delete your account at any time by contacting support; unused lead credits or subscription fees are subject to our Refund Policy.
12. Governing Law & Dispute Resolution
These Terms are governed by the laws of India. Any disputes arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts of [City], India.
13. Changes to These Terms
We may revise these Terms at any time. Material changes will be communicated via email or a notice on the Platform. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
